Sexual Assault Discrimination Against Men
Rape is one of the most
serious forms of sexual offences perhaps only less serious than murder under
the criminal law in most country’s Common Law. It is seen as an aggravated or
heinous crime by one person against another today the cardinal aim of the law
of rape is to protect a woman or girl from sexual assault or sexual harassment
with none of such law in place for a man or boy. It’s saddening to note that
right from ancient time laws have been in place protecting women from rape
therefore making it a man’s fault whenever rape is reported.
There was a time ancient
laws were said to be explicitly designed to protect men from false accusation
of rape, which was was fair for a while, but criticism on the law by
society that it placed more value on preventing false accusation than
protecting women from actual rape complicated things afterwards
The weight of punishment
attached to rape may stem from the fact that it is widely committed against
those who the society considered to be the weaker sex (women) in the society,
and because of this awareness many women now use it as yardstick to
fabricate lies on men by accusing them wrongly, and when such case is brought
before the law the courts in applying its doctrines assume the women are always
the victims making the men helpless in
defending themselves against charges of rape, and also special rules makes it
difficult to achieve conviction therefore making the trial an ordeal for the
accused
If we are to be honest
we’ll realize all law against rape favors the women and none in place for the
men, under most criminal law it seems it’s a
crime that can only be committed by a male against a female this is because a
woman is not physically capable of penetration, therefore making penetration one
of the major requirements offence of rape. The question that comes to mind
after reading this is whether penetration is limited to male organ alone, what
about penetration of the anus or mouth with object.
